Terms of sale.

What you buy, what you get, and how it works. Last updated: July 2026.

1. Scope

These terms govern the sale of Termal OS licenses by TERMALOS(SE) — David Christian G., Perpignan (66000), France, SIRET 42966800700058 (the “Publisher”) to any customer (the “Customer”). Placing an order implies full acceptance of these terms.

2. Product

Termal OS is a desktop application for Windows, macOS and Linux that supervises and administers Linux servers over SSH. It is self-hosted: it runs on the Customer's machine, installs no agent on the servers, and no server data is transmitted to the Publisher. A termalos.com account is used solely to issue and validate the license.

A free edition is available with no time limit for one server. Paid plans unlock additional servers, users and features, as described on the pricing page.

The AI copilot requires the Customer's own API key from a third-party provider (Anthropic, OpenAI, Mistral, Groq or any compatible endpoint). The corresponding usage is billed to the Customer by that provider, not by the Publisher, and is not included in the license.

3. Prices

Prices are shown in euros on the pricing page and are the amounts actually charged: VAT not applicable, art. 293 B of the French CGI. Licenses are flat annual fees — there is no per-seat pricing. The Publisher may change its prices at any time; the price applicable to an order is the one displayed at the time of purchase.

4. Order & payment

Orders are placed online from the Customer's account. Payment is processed by Stripe Payments Europe Ltd; card details are entered on Stripe's servers and are never transmitted to or stored by the Publisher. The order is confirmed once Stripe validates the payment, after which the license is issued automatically.

5. Delivery

Delivery is immediate and digital: the license is activated on the Customer's account as soon as payment is confirmed, and is applied in the application by signing in from Settings → License. The software itself is freely downloadable from the download page.

6. Right of withdrawal

Under art. L221-18 of the French Consumer Code, a consumer normally has fourteen (14) days to withdraw from a distance contract.

Important — waiver. The license is digital content supplied immediately, before the end of that period. In accordance with art. L221-28, 13° of the Consumer Code, the Customer is asked at checkout to tick a box by which they expressly request immediate performance and acknowledge that they thereby waive their right of withdrawal once the license has been issued. Ticking that box is required to complete the purchase; the license is therefore not refundable once issued.

This waiver does not affect the statutory warranties, nor the Customer's ability to contact the Publisher: if the software does not work as described, write to hello@termalos.com — the free edition exists precisely so the product can be evaluated at length before any purchase.

7. Renewal & cancellation

Licenses are annual subscriptions renewed automatically each year at the then-current price, unless cancelled. The Customer may cancel at any time from their account or by writing to hello@termalos.com; cancellation takes effect at the end of the paid period, which remains fully usable until its term.

When a license ends or is downgraded, nothing is deleted: the application keeps working under the free edition, and any servers beyond the plan's limit are locked rather than removed.

8. License of use

The Publisher grants the Customer a non-exclusive, non-transferable right to use Termal OS for the duration of the subscription, within the limits of the plan purchased (number of servers, users and device activations). Termal OS is proprietary software: reselling, sublicensing, redistributing, decompiling or reverse engineering it is prohibited, except where such acts cannot lawfully be restricted.

9. Support

Support is provided by email at hello@termalos.com. Response priority depends on the plan, as indicated on the pricing page. Support covers the software itself, not the administration of the Customer's servers.

10. Liability

Termal OS is an instrument: it executes, on the Customer's servers, the commands the Customer chooses. It does not review them for safety, and a command run through it has the same effect as one typed into an SSH session — including deleting data irreversibly. The Customer is the operator and remains solely responsible for what runs, for holding the authorizations to administer the servers concerned, and for maintaining working, tested backups.

The software is supplied “as is”. The Publisher does not warrant that it will be uninterrupted or error-free, nor that its metrics are accurate or complete.

To the fullest extent permitted by law, the Publisher is not liable for any indirect or consequential loss, nor for loss of data, loss of profit, downtime or damage to systems arising from use of the software — in particular where it results from a command the Customer executed or confirmed (including one suggested by the AI copilot), from a misconfiguration, from the absence of a usable backup, or from the failure of a third-party provider.

Where the Publisher's liability is nonetheless engaged, it is limited to the amount paid by the Customer over the twelve (12) months preceding the event, or, for the free edition, to fifty (50) euros.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or wilful misconduct, for gross negligence, or for any liability that cannot lawfully be excluded — including, for consumers, the statutory warranties of conformity and against hidden defects. If you are a consumer, these terms do not affect your statutory rights.

11. Governing law & disputes

These terms are governed by French law. In the event of a dispute, the Customer should first contact hello@termalos.com to seek an amicable solution.

Consumers may also use the European Online Dispute Resolution platform, or refer the matter to a consumer ombudsman. Failing an amicable settlement, the competent courts are those provided for by law.
